These terms apply to the Keho iPhone app and to this website, both provided by Coinlex – Thaiss GbR, Am Dorfanger 12, 25486 Alveslohe, Germany (“we”, “us”). By using Keho you agree to them.

1. What Keho is

Keho is a health and fitness app for iPhone. It reads and writes data in Apple Health, computes statistics from it, and — if you connect a Polar account — fetches data from Polar’s API and writes it into Apple Health. On top of that data it offers a daily readiness verdict and briefing, computed on your device from your own historical baselines. As Keho develops, it may also offer coaching features such as training guidance, adaptive plans, weekly reports and nutrition guidance on the same on-device basis.

Keho evolves in stages. Which features are available to you at any time depends on the app version and the products you hold; the App Store listing describes the current version. Features may be introduced gradually, changed or removed (see section 6).

2. Not medical advice

Keho is not a medical device and does not provide medical advice, diagnosis or treatment. Readiness verdicts, suggestions, the overnight-vitals alert and every statistic are informational and advisory only, derived from data your own devices recorded. They can be wrong, and they can be missing.

Never use Keho to make a decision that should involve a clinician. If you feel unwell, or if something about your health worries you, speak to a qualified healthcare professional — regardless of what the app says. Do not ignore medical advice because of anything Keho shows you.

The same applies to any training and fueling guidance Keho provides. Plans, suggested sessions and nutrition estimates are general fitness information for healthy adults — not personal medical, therapeutic or dietary advice. If you are pregnant, have a medical condition or an eating disorder, or take medication that affects training or nutrition, involve a qualified professional before following any plan or fueling suggestion.

3. Licence

Keho is licensed to you, not sold. Your licence to use the app is governed by Apple’s Licensed Application End User License Agreement (the “standard EULA”), which is available from Apple, together with these terms. Where the two conflict on the licence itself, Apple’s standard EULA prevails.

You may not reverse-engineer, decompile or redistribute the app except as permitted by applicable law, and you may not use it in a way that breaks the law or interferes with the service for others.

4. Your account with other services

Connecting a Polar account is optional. When you do, you authorise Keho through Polar’s own sign-in to read your data on your behalf. Your relationship with Polar is governed by Polar’s terms; we are independent of Polar and have no control over its API, its availability, or the accuracy of the data it returns. You can revoke Keho’s access at any time.

Likewise, Apple Health is Apple’s; the permissions you grant are yours to withdraw at any time.

5. Purchases

The core statistics are free. Some features — advanced statistics, connector syncs such as the Polar sync, and coaching features — are paid. The current products, their prices and their terms are shown in the app before you buy, and in the App Store listing.

Where a one-time purchase is offered it stays a one-time purchase: it does not convert into a subscription. A “lifetime” purchase means the lifetime of the app — it unlocks the feature for as long as we offer Keho and that feature, with no recurring charge.

Subscriptions renew automatically for the stated period unless cancelled at least 24 hours before the end of the current period. You can manage and cancel them at any time in your App Store account settings; cancellation takes effect at the end of the period already paid.

Where a free period is part of a subscription, it is an App Store introductory offer. Apple determines who is eligible — generally once per subscription group, per Apple ID — and unless you cancel at least 24 hours before the period ends, the subscription starts and Apple charges the price shown. You can cancel at any time in your App Store account settings.

Some free periods are not tied to a purchase at all. Those simply end, with nothing charged and nothing to cancel. Which kind applies, how long it runs and what it covers are shown in the app before it starts.

Apple is the merchant of record for every purchase. Billing, receipts, subscription management, refunds and any statutory withdrawal rights are therefore handled by Apple under its Media Services terms, not by us. Purchases restore across your devices.

Data already written into Apple Health remains yours whether or not you hold any purchase. If a paid feature lapses, we do not delete or lock what has already been synced.

6. Availability and change

We develop Keho actively, and features may be added, changed or removed. Third parties we depend on — Apple’s frameworks, Polar’s API — can change or break without notice, and some things Keho does today may become impossible through no fault of ours. We do not promise uninterrupted or error-free operation.

7. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and to the extent liability cannot be limited under applicable law, including under the German Product Liability Act.

For slight negligence we are liable only where we breach a material contractual obligation, and only for foreseeable damage typical of this kind of agreement. All other liability is excluded.

Nothing in these terms limits the statutory rights you have as a consumer.

8. Third-party trademarks

Polar and Polar Flow are trademarks of Polar Electro Oy. Apple, iPhone, Apple Health, HealthKit, Siri and App Store are trademarks of Apple Inc. Keho is an independent app; it is not affiliated with, endorsed by or sponsored by Polar Electro Oy or Apple Inc. These names are used only to describe compatibility.

9. Changes to these terms

We may update these terms for good reason — a new feature, a change in the law, or a gap that needs closing. The version published here applies, and the date at the top tells you when it last changed; material changes will also be noted in the app’s release notes. Changes never reduce your statutory rights or apply retroactively to purchases you have already made.

10. Governing law

German law applies. If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory law of your country of residence.

11. Consumer dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
